The tourism market has evolved with new travel trends. Today, many tourists seek direct interaction with local residents, while others prefer complete autonomy—something traditional hotels or apartment complexes cannot provide. The rise of online booking platforms has significantly broadened the variety of holiday accommodation options.
These digital platforms also reduce intermediaries, making holiday rentals more affordable while maintaining the quality and security guarantees associated with traditional rental offerings.
This evolving landscape necessitates tailored legislation to protect both landlords and tenants, establish minimum standards for infrastructure and service quality, and regulate short-term rentals to prevent illegal operations, unfair competition, and degradation of market quality.
Key criteria to qualify as holiday accommodation—distinct from tourist apartments or rural lodging—include:
To register a property for holiday rentals—and obtain the necessary touristic number—you must complete two essential steps: submit a declaration of responsibility to the Ministry of Tourism, and maintain a guest register with either the National Police or Guardia Civil.
This declaration must be signed by the owner—or their representative—and attests that the property meets all legal standards for holiday rental. Key requirements include:
After submitting the declaration of responsibility, the Ministry of Tourism issues the touristic registration number that officially identifies the property within the holiday rental registry.
The next step requires registration with the National Police or Guardia Civil. You'll need to provide:
This registration with either security authority is mandatory to maintain a registry of all guests over 14 years old. Information must be submitted within 24 hours of arrival—either in person at the Police or Guardia Civil station, or online via Webpol or Hospederías platforms.
In addition, hosts must maintain records of guest data and copies of their identification documents for a period of three years. Non-compliance may result in penalties against the property owner.
Holiday rentals can be profitable, but they require careful management and compliance. For detailed legal information, see the official links below (primarily available in Spanish):
